Call the police immediately! Remember, Protective Orders are merely pieces of paper and they will not stop an offender who is determined to cause you harm. The Crime Victims Office is dedicated to helping victims of crime and can help you with referrals to local shelters, help you apply for Crime Victims Compensation benefits and establish a safety plan for you. Law enforcement agencies are notified of all Protective Orders issued in their area and they are required to maintain a list of those orders. If an offender violates the order and law enforcement is notified, officials will act to arrest the offender and seek to have charges filed. If a person violates the protective order in the presence of law enforcement, the offender must be arrested immediately. In cases involving the violation of a protective order, including an ex parte order, the offender may be punished for contempt of court by a fine of as much as $500 or up to six months in jail or both. In cases of violation, excluding ex parte orders, the offender may be punished by a fine of as much as $4,000 or jail for up to one year or both. Am I Eligible for Crime Victims Compensation? If you are a victim of family violence, it is likely that you will qualify for Crime Victims Compensation. This is a financial assistance program that helps eligible victims with certain expenses related to a crime committed against them, which may include the costs associated with relocating to get away from a violent household. It is important to note that an offense report is typically needed for the Office of the Attorney General to make an eligibility decision, so you should always contact law enforcement during any violent situation to ensure that there is an official record of the offense. Crime Victims Compensation can help ease the burden placed on victims in many ways, including counseling, medical expenses, travel, lost wages, loss of support, rent and relocation, and much more. Coryell County is one of many counties in Texas that is requiring victims to attend an Options Class in the instance that they decline to prosecute their offender for family violence. Three hours of education and information will be provided to you through Families in Crisis, Lone Star Legal Aid and the Crime Victims Office. Important Information on Protective Orders in Coryell County OBTAINING A PROTECTIVE ORDER A Protective Order is a civil court order issued to prohibit continuing acts of family violence. Protective Orders may prohibit a person from committing further acts of family violence, which is physical harm, assault, sexual assault, or the threat of any of these things against a member of a family or household, as well as harassing or threatening the victim directly or communicating the threat indirectly through another person, going to or near a school or daycare center attended by a child under the order or possessing a firearm. In some situations, a protective order may also prohibit transfer or disposal of property, establish possession and visitation of a child, order payment of child or spousal support for a period not to exceed one year, require mandatory counseling, or require a person to vacate the residence or other specified property, if certain conditions are met. These additional provisions are not criminally enforceable. A person who violates them is not immediately arrested, but may be taken to civil court, found in contempt, fined and jailed. What is a Protective Order Three Means to Obtain Court Ordered Protection from Family Violence A Magistrate s Order for Emergency Protection is similar to a protective order, but is only in effect for up to 61 days. You must tell the arresting officer that you want the Magistrate Order. The Magistrate should then issue the Order while the abuser is in jail. A Magistrate Order is enforceable by fine and imprisonment. An Ex Parte Protective Order may be sought when there is clear and present danger of family violence. This Order is issued by a Judge on an emergency basis when an application for a Protective Order is filed. An abuser can be ordered out of your residence if he has lived there for at least 30 days and family violence has occurred within 30 days of the date the application is filed. The Ex Parte Order can provide protection for up to twenty days. This Order is enforceable through a Contempt Order. A Protective Order is issued after a hearing in which a Judge finds that  family violence has occurred and is likely to reoccur. The abuser is ordered to stop committing further family violence. The Order also prohibits the abuser from: making threats; going to or near your residence, employment or your child s school or daycare. The Order may also provide for temporary visitation and child or spousal support. The Order may be in effect for up to two years. Who is Eligible for a Protective Order? A protective order may be issued to a victim of family violence or dating violence as defined by the Texas Family Code or a sexual assault victim who has been threatened with further harm. Protective Orders may be issued in a wide range of situations, but generally must prove that family violence has occurred and is likely to occur again in the future. The victim and alleged offender may be married, divorced, live or formerly lived together in the same household, have or used to have a dating relationship, or have a child together. An adult member of a family or household may apply for a protective order on behalf of another family member, and any adult may apply for an order to protect a child from family violence. In addition, a prosecuting attorney may apply for an order to protect an alleged victim of family violence or sexual assault, and the Dept. of Protective and Regulatory Services may request an order on behalf of a family violence victim. A person who has a divorce pending is eligible for a Protective Order, but it must be filed in the Court where the divorce is pending. How Do I Apply? You can apply for a protective order in person through the Crime Victims Office. Call to schedule an appointment and we will meet you at our office in Gatesville or in Copperas Cove. The application must be filed in the county in which you or the defendant lives. There are no minimum time limits to establish residency and Protective Orders are available in every county in Texas. There is no charge to the victim; however, the Court shall require the respondent to pay the fees incurred in connection with the Protective Order unless the respondent shows good cause or is indigent. An applicant for a Protective Order may not be charged a fee, cost, charge or expense by any clerk, sheriff, constable or other public official or employee. There is no cost for legal representation provided by the County Attorney or Crime Victims Office in relation to the Protective Order. When you apply for a Protective Order, you must provide the following information for each person to be protected: Name of each applicant and their county of residence; name, address, county of residence and identifiers (date of birth, drivers license, etc.) of person who has committed family violence; and the relationship between applicant and respondent . The victim should file for the order as soon after the incident has occurred as possible. How Long Does It Take? Unless a later date is requested by the applicant, the court shall set a hearing date no later than 14 days after the application is filed. If, however, the court finds from the information contained in the application that there is a clear and present danger of family violence, the court may immediately issue a temporary ex parte order, which is valid for up to 20 days. Final protective orders are effective for up to two years. What Should I Do If I Move? A Protective Order is enforceable anywhere in the United States regardless of where it was issued.
